Selecting a Lawyer
Selecting a Lawyer...

Unlike many other countries in the world, the United States is a country of laws. These laws are broken down into very specialized categories, such as Tax Law, Bankruptcy Law, Probate Law, Real Estate Law, Medical Malpractice law and Personal Injury Law, among others. Selecting the right lawyer, one with skill and knowledge in a particular area of law is critical. Much like not going to an orthopedic surgeon to treat a vision problem, one should be equally selective with the lawyers that are to handle a personal injury claim.

All too often people speak with a lawyer and choose the lawyer simply because he or she will listen or is friendly and forego an in-depth interview or research into the lawyers background and experience. Attorneys should be chosen for their experience and skill in specific fields of law. Finding the right attorney means that the lawyer will understand what to do immediately and does not say he or she will call you back in a few weeks, etc.

Finding a lawyer who specializes in a specific field of law is time-consuming, but necessary. Although speaking with friends and relatives about their recommendations is beneficial, relying on their advice completely will not be beneficial to you. Research the recommendations on the web. First, go to the Florida Bar's website (www.flabar.org) to see if the lawyer has been disciplined, then look into other legal sites such as www.lawyers.com or www.findlaw.com. Then call the lawyer and ask him or her to send you his or her CV or resume. Ask the lawyer how much of their practice is devoted to litigation or trial work.

Lastly, interview the lawyer in person. Ask him questions about his trial experience, his education, his background, his litigation style. You would not buy a new home without having it inspected, or speaking with the owner, or researching the property on Internet. Why would you hire a lawyer without looking into his or her qualification. If the lawyer feels uncomfortable or does not wish to provide you with information on his background or experience, then this lawyer is probably not for you.

At your initial meeting with your lawyer, you should provide a succinct summary of your situation and your injuries. It would be very helpful to bring with you a short written summary (1-3 pages) of all the pertinent information, such as the date of the incident, your health insurance information, police reports, photographs, hospital names and addresses, your work information, names and telephone numbers of witnesses, copies of your driver's license (if you have one), details of your injuries, medical bills, etc.
